Data Protection Statement (GDPR)

Introduction

Smart Broker is a trading style of Smart Funding Solutions Limited. To arrange funding for our clients, we need to collect and use personal information about clients, their businesses and the people we deal with. This statement explains how we make sure that information is collected, handled and stored lawfully and securely, and how we respect your rights.

Data protection law

We handle personal data in line with UK data protection law. That means personal data must be processed lawfully, fairly and in a transparent manner; collected for specified and legitimate purposes; limited to what is necessary; accurate and kept up to date; kept no longer than necessary; and protected with appropriate security. We keep records of our processing activities, and we retain personal data for six years in line with Financial Conduct Authority guidelines.

Lawful basis for processing

We mainly rely on the contractual basis: processing that is necessary at your request before you enter into a finance agreement. Other lawful bases we may rely on are consent, legal obligation, vital interests, public task and legitimate interests.

Subject access requests

Responsibility for data protection

Smart Funding Solutions Limited has not appointed a formal Data Protection Officer. Responsibility for data protection compliance is held by the directors and those responsible for the management of the business.

If you have any questions about how your personal data is handled, or wish to exercise your data protection rights, please contact us at info@smartfundingsolutions.co.uk. If you are not satisfied with our response, you can complain to the Information Commissioner's Office (ICO) at ico.org.uk.

Data security and storage

Paper records are stored securely in locked facilities. Electronic data is protected by strong passwords, encryption, secure servers and approved security software. Data is encrypted when transferred, and personal data is not saved to personal devices.
